Wisconsin Stay-at-Home Order Overturned

COVID-19, Employee Benefits, Property & Casualty

On Wednesday, May 13, 2020 the Wisconsin Supreme Court overturned most of Wisconsin’s Emergency Order #28, which had extended the “Safer at Home” order for the entire state. It should be noted that the ruling does still allow for the closure of schools.  This ruling is effective immediately.

In the decision, the Court encourages the Legislature to work with the Governor to establish new rules relative to the COVID-19 pandemic. As the legislative process unfolds, local government bodies (county and cities) have the ability to implement rules. The local reaction can range from mirroring the requirements of Emergency Order #28 to not implementing new rules.

Organizations should continue to follow the guidelines provided by the Centers for Disease Control and Prevention (CDC) in your operational decision-making.

Key Takeaway

This Court decision immediately overturns Emergency Order #28. Organizations would be well-served to understand the rules of their local government bodies and track changes at the state level concerning public health.
